Residual Markets and Miscellaneous Insurance

The Florida legislature creates residual market organizations to be an “insurer of last resort” to issue insurance policies to those persons who cannot find coverage anywhere. These organizations come in several forms including, but not limited to, Joint Underwriting Associations (JUA’s), Health Associations, and Compensation Funds. Certain policy contracts and rates are subject to Office approval. JUA Plans of Operation are subject to approval by the Office, with the exception of Citizens Property Insurance Corporation, where the Plan of Operation is approved by the Financial Services Commission (which is comprised of the Governor, the Chief Financial Officer, the Attorney General, and the Agriculture Commissioner). Below is a list of the current residual market organizations in Florida, a brief description of each one, and a link to their website (if they have one).

FMAP is a free referral service designed to match consumers, who cannot find property insurance, with Florida licensed agents and insurers who are writing new business.

The Florida Automobile Joint Underwriting Association (FAJUA) was created pursuant Sections 627.311 and 627.351, Florida Statutes, by order of the Insurance Commissioner Dated February 9, 1973, for the purpose of establishing and carrying out a program for providing automobile insurance to qualified applicants unable to procure such insurance in the voluntary market at rates below the FAJUA.

The Florida Birth-Related Neurological Injury Compensation Association (NICA) was created by the Florida Legislature in 1988. NICA is a statutory organization that manages the Florida Birth Related Neurological Injury Compensation Plan ("Plan") used to pay for the care of infants born with certain neurological injuries.

  • Florida Patients’ Compensation Fund (FPCF)

Created in 1975 as a fund to be utilized by health care providers to pay that portion of any claim for bodily injury or property damage sustained by any patient, the FPCF has taken no new policies since June 3, 1983.

Florida Medical Malpractice Joint Underwriting Association (FMMJUA) is a state sanctioned insurance plan for medical malpractice coverage. The FMMJUA provides professional liability insurance coverage in Florida for health care providers that cannot find coverage in the open market.

The mission of the Florida Surplus Lines Service Office (FSLSO) is to protect consumers and state revenues by facilitating industry compliance and serving as a source of information and advice concerning the surplus lines insurance marketplace in the state of Florida.

The FWCJUA was created during the 1993 legislative session to provide employers with workers' compensation insurance in the State of Florida who are unable to obtain coverage in the private marketplace.
