Unauthorized Company Ordered To Stop Selling Medical Malpractice Insurance In Florida
Tallahassee -The Florida Office of Insurance Regulation has ordered First Actual American Insurance Company to immediately stop sales and marketing of bogus medical malpractice liability insurance. First Actual American Insurance Company has been marketing medical malpractice insurance by faxing sales materials to doctors throughout the state.
First Actual American Insurance Company and all its related entities and individuals are not authorized to transact insurance in Florida. The company had claimed it had authority through the Little Shell Pembina Band of North Dakota. According to state regulators, the United States Bureau of Indian Affairs does not recognize this tribe.
OIR Director Kevin McCarty said he was thankful for the prompt inquires his office received from Florida physicians and licensed insurance agents, as a result "we were able to quickly stop this fraudulent entity from infiltrating the Florida market. We have been aggressively pursuing all types of unauthorized insurance entities and value the help we receive from the public."
It is a third-degree felony for any person to act as insurer, transact insurance or otherwise engage in insurance activities in this state without a license. Further the 2003 Florida Legislature passed the Pete Orr Bill, which will make unauthorized insurance operators subject to being charged with up to a first-degree felony.
The Office of Insurance Regulation began its investigation of First Actual American Insurance Company in response to registered complaints but is not aware of any Florida doctor who actually purchased any medical malpractice insurance from this group. Mississippi, Oregon, Georgia, and North Dakota have issued similar cease and desist actions against the company.
A statewide media campaign alerting Floridians to Verify Before You Buy has been operating since 2001, warning consumers to avoid buying insurance from unlicensed entities.
