Office Statement on Florida First District Court of Appeal Reinstating the PIP Stay of Injunction
The Florida First District Court of Appeal (DCA) yesterday reversed an injunction that stopped implementation of key provisions of the 2012 PIP law revisions. The DCA ruled that the chiropractor, acupuncturists, and massage therapists lacked “standing” to bring the claim that the PIP revisions restricted a motorist’s constitutional access to courts right. The court did not rule on the merits of whether the PIP law revisions are valid if there is a proper plaintiff.
By separate order the court reinstated the stay of the trial court’s injunction that stopped implementation of the key provisions of the 2012 PIP law revisions. This means the 2012 PIP law revisions are now fully in effect.
The appellate court’s opinion is not final until the time for motions for rehearing expires.
